Defense of Protective Order Violation Charges

Protective orders can be extremely difficult to comply with, particularly if the two parties have children together or work at the same place.

There are two things many people do not realize about protective orders.

1. The ban on communication is a one-way street. The person named in the protective order cannot contact the complaining party. The order does not work the other way around. The person who made the complaint can contact the person named in the order.

2. The terms of the protective order cannot be waived. It stays in place until a judge dismisses it. You can be charged with violation of a protective order even if the other party invited you to get together.

In these cases, I encourage my clients to save any e-mails or text messages from the other party. The court may consider responding to a message sent by the other party differently from initiating contact yourself.

I will review the facts and the motives behind these allegations. False allegations of protective order violations are not uncommon. I will thoroughly investigate the facts and prepare to take the case to trial. However, most protective order violation cases are settled outside of court.
