Fighting Protective Orders

Defense of Restraining Orders, Protective Orders

I am Steven M. DuBreuil, a Salt Lake City attorney with a record of success in fighting protective orders.

A protective order, sometimes called a restraining order, is issued by a judge when a person complains of being abused, threatened with violence, harassed or stalked by a member of their own household or by someone with whom they have had a dating relationship. Protective orders prevent the person named in the order from coming near the alleged victim, and from contacting the complaining party by phone, e-mail, text, mail or even through a third party.

When possible, I take a proactive approach, by helping you avoid the imposition of a protective order. I can also petition the court to dismiss a protective order that has been in place. Without this action, a final protective order remains in place for a long time leading to years of problems.

Fighting the Imposition of Protective Orders

Restraining orders can make it extremely difficult to live your life, raise your children and go about your business. I will represent you at a hearing that will determine whether a temporary restraining order becomes a final one.

In a recent case, I proved that the alleged victim had falsely accused my client of threatening to kill her and another family member. I showed that there was no record of such threats in the initial police report.

It was particularly important that this client be able to retain his right to possess firearms because he owned a hunting lodge. Had a final protective order been issued, he would not have been able to pursue his occupation.

It is important to speak to a lawyer about your case as soon as possible. In domestic violence cases, you can lose certain rights if you miss deadlines. To arrange a free, one-hour consultation about your case, please contact my office in Sandy, Utah, by e-mail or call 801-326-3695.
