DUI Defense Lawyer: Driver's License Hearings
If you have been arrested for DUI, time is of the essence. You only have 10 days from the date of the arrest to request a hearing to fight the automatic suspension of your driver's license. If you do not request this hearing within that time limit, your driver's license will be suspended. Just going through the hearing process gives you a fighting chance of keeping your license.
I am Steven M. DuBreuil, a Salt Lake City criminal defense attorney who has successfully represented many clients at DUI license suspension hearings. Please contact my office to arrange a free initial consultation to discuss your legal concerns.
What Can You Do?
As in all areas of my practice, I make the government do its work. If the state of Utah is going to deprive my client of the right to drive, I make certain that the police followed the letter of the law. Before this administrative hearing, I will review the police report and all associated paperwork. I will talk to you about exactly what happened before, during and after the arrest.
I will request that the arresting officer be present at the hearing. If the officer doesn't show up, you win automatically. If the officer attends, I will ask pointed questions to determine whether there was reasonable suspicion to stop your vehicle and probable cause to arrest you for DUI.
- What led the officer to believe you may have been intoxicated?
- What field sobriety tests were administered?
- Did the officer administer all tests correctly?
- Was the officer trained in the administration of the tests?
- Was all paperwork completed correctly?
Always Request a Hearing
I frequently achieve successful results for clients in driver's license hearings. Even if the license is suspended, this hearing can give me important information that can be of benefit to the client's criminal case.
