The police will have to answer many questions about the blood or breath test. For example:

- Was the blood test properly labeled and handled? Was it contaminated?
- Was the blood sample large enough to provide significant results?
- Was the Breathalyzer correctly calibrated and in working order?
No technology is perfect 100 percent of the time. Cell phones sometimes drop calls. Computers crash. Even Toyotas are recalled. Breathalyzer machines are not infallible, and juries understand that.
Should You Refuse the Test?
You can refuse to submit to a blood or breath test. If you refuse, your driver's license suspension will be longer. For people who have multiple DUIs, it may be wise to refuse the test. If you refuse you can lose your license based on the refusal. Each case is different. An attorney can help you determine what would be in your best interest.
